OkieSIM Terms and Conditions
Дата вступления в силу: 19 September 2026
1. Introduction and Acceptance
1.1 OkieSIM (the "Platform", "we", "us", "our") is a digital eSIM data plan marketplace operated by Flow Travel Technology Limited ("Flow", "the Company"), a company incorporated in Hong Kong with Business Registration Number 67239515. OkieSIM is accessible at www.okiesim.com and any associated mobile applications (together, the "OkieSIM Platform").
1.2 These Terms and Conditions ("Terms") govern your access to and use of the OkieSIM Platform, and your purchase of eSIM data plans through it. By accessing the OkieSIM Platform, placing an order, or otherwise using our services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the OkieSIM Platform.
1.3 You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding contract, to purchase from OkieSIM.
1.4 Nothing in these Terms affects any right you have under the mandatory consumer protection law of your country of residence that cannot be excluded or varied by agreement. Where a provision of these Terms conflicts with such a right, that right prevails to the extent of the conflict.
1.5 If you purchase as a consumer resident in the European Economic Area or the United Kingdom, section 9 explains your statutory right to withdraw from the contract and the circumstances in which that right is lost.
2. Definitions
"eSIM" means an embedded SIM profile delivered digitally (typically as a QR code and/or activation code) that can be installed on a compatible device to provide mobile data connectivity, without the need for a physical SIM card.
"Data Plan" means a bundle of mobile data (and, where stated, voice/SMS allowance) made available for purchase and activation on the OkieSIM Platform, tied to a specific destination, region, or network.
"Network Partner" means the mobile network operator(s), eSIM/data platform aggregator(s), or other wholesale connectivity provider(s) through which OkieSIM sources and provisions Data Plans.
"Order" means a request to purchase a Data Plan submitted through the OkieSIM Platform.
"You" or "User" means any person who accesses the OkieSIM Platform or purchases a Data Plan.
"Activation" means the first registration of your device on a Network Partner network at the Destination using the Data Plan.
"Destination" means the country, region, or group of countries in which a Data Plan is stated to provide coverage.
"Fair Use Policy" means any fair use, traffic management, or speed limitation applicable to a Data Plan, as published on the OkieSIM Platform for that Data Plan at the time of purchase.
"Top-Up" means an additional data allowance or extension of validity that we may make available for purchase in respect of an existing Data Plan.
3. The OkieSIM Service
3.1 OkieSIM sells digital eSIM Data Plans for use in destinations worldwide. We do not manufacture, own, or operate any mobile network. Depending on the destination, Data Plans are sourced either (a) through one or more third-party eSIM/connectivity aggregators who in turn contract with local mobile network operators, or (b) through direct commercial arrangements between Flow and local mobile network operators. The identity of the underlying Network Partner for a given Data Plan may not be disclosed to you, and coverage, speed, and quality of service depend on that Network Partner's network, which is outside our control.
3.2 Data Plans are data-only unless the OkieSIM Platform expressly states that a voice or SMS allowance is included.
3.3 IMPORTANT - EMERGENCY CALLS. A data-only Data Plan does not support voice calls and cannot be used to contact emergency services, including 999, 112, 911, or any local emergency number. Even where a Data Plan includes a voice allowance, we do not guarantee that emergency calling, emergency location information, or emergency messaging will be available, routed correctly, or accurate. You must not rely on a Data Plan as your only means of contacting emergency services, and you should keep an alternative means of doing so available at all times.
3.4 Flow Travel Technology Limited is the service provider responsible for the OkieSIM Platform. OkieSIM resells connectivity sourced from Network Partners and does not itself act as a mobile network operator or licensed telecommunications carrier in any jurisdiction unless expressly stated.
4. Accounts and Guest Checkout
4.1 You may purchase a Data Plan on a guest-checkout basis by providing a valid email address, without creating an OkieSIM account. If you check out as a guest, we will not link your order or contact information to a Flow Rewards membership, and we will not make it available to Flow's hotel booking platform at app.flowtheroom.com for membership or marketing purposes. Guest checkout does not by itself set your OkieSIM marketing preferences; section 14 explains how those are set and changed.
4.2 Alternatively, you may create an OkieSIM account, or sign in using your existing Flow account credentials, to track your Orders and access your eSIMs. If you create or link an OkieSIM account, your email address will be linked with your Flow account at app.flowtheroom.com for cross-platform membership purposes. Because that is a use of your personal data beyond fulfilling your Order, we will ask for your express consent at the point you create or link the account, and you may withdraw it at any time, as described in our Privacy Policy.
4.3 Your eSIM, order confirmation, and related communications will be sent to the email address you provide. You are responsible for ensuring that the email address you provide is accurate and accessible, and for the security of any account credentials, device, or inbox used to receive your eSIM.
5. Orders, Pricing and Payment
5.1 All prices displayed on the OkieSIM Platform are shown in the currency indicated at checkout and are inclusive of applicable taxes unless stated otherwise at checkout. Where the law of your country of residence requires us to charge value added tax, goods and services tax, sales tax, or a similar consumption tax on digital services, that tax will be shown before you pay. Any currency conversion charge or international transaction fee applied by your bank or card issuer is outside our control and is your responsibility.
5.2 Placing an Order constitutes an offer by you to purchase the selected Data Plan at the displayed price, which becomes binding once we confirm the Order and process payment.
5.3 Payment is processed through third-party payment gateway providers. We do not store your full payment card details. By submitting payment information, you represent that you are authorized to use the payment method provided.
5.4 We take reasonable measures to ensure the security of transactions on the OkieSIM Platform but are not liable for unauthorized charges arising from use of the Platform except to the extent caused by our negligence, subject to your statutory rights.
5.5 We reserve the right to refuse or cancel any Order, including where we suspect fraud, an error in pricing or availability, or a violation of these Terms, in which case we will refund any amount paid for the cancelled Order.
6. Delivery of Your eSIM
6.1 Upon successful payment, your eSIM (typically a QR code and/or manual installation details) will be delivered digitally to the email address you provided and/or made available via the order confirmation page or, where applicable, your OkieSIM account.
6.2 You are responsible for installing the eSIM on a compatible, carrier-unlocked, eSIM-enabled device with an active internet or Wi-Fi connection, following the installation instructions provided. Please check your device against the compatibility information published on the OkieSIM Platform before you purchase. Where a device is not compatible and that was ascertainable from the published information, we are not obliged to refund you, subject to your statutory rights.
6.3 An eSIM QR code can typically only be scanned and installed once. If you delete the eSIM profile after installation, or attempt to install it on more than one device, it may become unusable, and we are not obliged to issue a replacement or refund.
7. Validity, Activation and Expiry
7.1 Each Data Plan has a validity period (for example, a number of days of data allowance) as stated on the Platform at the time of purchase.
7.2 Unless stated otherwise for a particular Data Plan, the validity period begins when your device first connects to the relevant Network Partner's mobile network at the destination (network registration), not at the time of purchase or installation of the eSIM profile.
7.3 The eSIM profile itself must be installed within _____ days of purchase, after which the QR code may expire and become unusable, whether or not the Data Plan's validity period has started.
7.4 Once the validity period has started, unused data does not carry over beyond the stated validity period, and the Data Plan cannot be paused, extended, or transferred to another Data Plan except where we expressly offer a Top-Up. A Top-Up is a separate purchase governed by these Terms and, unless the OkieSIM Platform states otherwise, must be purchased and applied before the existing Data Plan expires.
7.5 Actual data speeds, network availability, and coverage depend on the relevant Network Partner and local conditions and are not guaranteed by OkieSIM.
8. Fair Use and Network Management
8.1 Where a Data Plan is described as unlimited, it is subject to the Fair Use Policy published for that Data Plan. The Fair Use Policy states the volume of data available at full speed and the reduced speed that applies once that volume is used. We will present the Fair Use Policy clearly and prominently before you purchase, and we will not describe a Data Plan in a way that is inconsistent with it.
8.2 Tethering, mobile hotspot use, and ordinary personal use of a Data Plan are permitted unless the OkieSIM Platform states otherwise for a particular Data Plan.
8.3 Network Partners may apply traffic management measures, including prioritisation and speed limits, during periods of congestion or where use of a Data Plan materially degrades the network for other users.
8.4 A Data Plan is supplied for your own use on a single device while travelling. It is not supplied for permanent roaming, machine-to-machine or IoT deployment, bulk messaging, or resale, and we may suspend or terminate a Data Plan used for any of those purposes in accordance with section 12.
9. Cancellations and Refunds
9.1 You may request a refund at any time before the eSIM has been installed and/or activated on a device (that is, before the Data Plan's validity period has begun under section 7.2). To request a refund, contact support@flowtheroom.com with your order details.
9.2 If you are a consumer resident in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from this contract within fourteen days of the day we confirm your Order, without giving a reason. Because a Data Plan is digital content supplied otherwise than on a tangible medium, you lose that right once supply has begun, provided you have given your express prior consent to supply beginning immediately and have acknowledged that you will lose your right of withdrawal. We ask for that consent and acknowledgment at checkout, and your eSIM is not issued until you give them.
9.3 Where you have not given the consent and acknowledgment described in section 9.2 and the fourteen-day period has not expired, you may withdraw by contacting support@flowtheroom.com, and we will refund you in full within fourteen days of receiving your notice.
9.4 Once an eSIM has been installed on a device and/or its validity period has begun, the Order becomes non-refundable, except where required by applicable law or where the Data Plan could not be used due to a verified fault on our part or that of our Network Partner.
9.5 We may, at our discretion, offer a refund, replacement eSIM, or platform credit where a Data Plan cannot be installed or activated due to a technical fault attributable to OkieSIM or a Network Partner, provided you notify us within a reasonable time and cooperate with our troubleshooting steps.
9.6 We reserve the right to decline a refund request where we reasonably suspect misuse, abuse of our refund policy (including repeated purchase-and-refund patterns), or fraud.
9.7 Approved refunds will be issued using the same payment method you used for the Order, within fourteen days of our approving the request, and at no cost to you.
10. Local Registration, Restricted Destinations and Sanctions
10.1 Some Destinations require a SIM or eSIM to be registered with identity documentation before service can be activated. Where that applies, we will tell you at the point of purchase and you must provide the information required. If you do not, or if the information you provide is rejected by the local authority or Network Partner, the Data Plan cannot be activated and we are not obliged to refund you, except where required by law.
10.2 Data Plans are not offered for, and must not be used in, any country or territory subject to comprehensive trade sanctions administered by Hong Kong, the United Nations, the United States, the United Kingdom, or the European Union. We may refuse or cancel any Order where supplying it would breach applicable sanctions or export control laws.
10.3 You confirm that you are not, and are not acting on behalf of, a person designated on any applicable sanctions list.
10.4 Some Destinations restrict or prohibit the use of foreign SIM or eSIM profiles, virtual private networks, or particular applications. It is your responsibility to check and comply with local law, and we accept no liability arising from your failure to do so.
11. Prohibited Use
11.1 You agree not to: (a) use the OkieSIM Platform or any Data Plan for any unlawful, fraudulent, or unauthorized purpose, including reselling Data Plans without our written permission; (b) use automated means (bots, scrapers) to access the Platform or place Orders without our permission; (c) attempt to interfere with, disrupt, or gain unauthorized access to the Platform, our systems, or any Network Partner's network; or (d) provide false or misleading information when placing an Order; (e) use a Data Plan for permanent roaming, machine-to-machine or IoT deployment, bulk messaging, or commercial resale; or (f) use the OkieSIM Platform or a Data Plan in breach of applicable sanctions or export control laws. Section 12 sets out the action we may take where we reasonably believe you have breached this section.
12. Suspension and Termination
12.1 We may suspend or terminate your access to the OkieSIM Platform, suspend or cancel a Data Plan, or close your OkieSIM account where we reasonably believe that you have materially breached these Terms, that your use is fraudulent or unlawful, that continued supply would breach applicable law, or that a Network Partner has required us to do so.
12.2 Except where doing so would be unlawful or would prejudice an investigation, we will give you notice before suspending or terminating, tell you the reason, and give you a reasonable opportunity to respond or to remedy the breach.
12.3 Where we suspend or terminate for a reason that is not your fault, we will refund the unused portion of any affected Data Plan. Where we do so because of your material breach, no refund is due except where required by law.
12.4 You may close your OkieSIM account at any time by contacting support@flowtheroom.com. Closing your account does not entitle you to a refund of a Data Plan whose validity period has begun.
12.5 Sections 10, 13, 16, 17, 20, 25, and 26 survive termination.
13. Intellectual Property
13.1 All content on the OkieSIM Platform, including text, graphics, logos, and software, is the property of Flow or its licensors and is protected by intellectual property laws. You may use the OkieSIM Platform for personal, non-commercial purposes to purchase Data Plans only, and may not copy, modify, distribute, or create derivative works from any content without our prior written consent.
14. Marketing Communications
14.1 We will use your personal data in direct marketing only where you have consented, or where we are otherwise permitted by law to do so. Before we first use your personal data in direct marketing, we will tell you, in an easily readable and understandable form and free of charge, the kinds of personal data to be used and the classes of marketing subjects involved, and we will provide a channel through which you may tell us that you do not consent. Section 11 of our Privacy Policy sets this out in full.
14.2 We will not provide your personal data to any other person for that person's use in direct marketing unless you have given separate written consent to that provision.
14.3 You may require us to stop using your personal data in direct marketing at any time and free of charge, using the unsubscribe link in any marketing message or by contacting support@flowtheroom.com. We will act on your request within ten working days. Opting out of direct marketing does not affect transactional communications relating to your Orders.
15. Disclaimers
15.1 The OkieSIM Platform and all Data Plans are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, and subject to section 16.4, we disclaim all warranties, express or implied, including as to network coverage, data speed, uninterrupted or error-free service, and fitness for a particular purpose.
15.2 We do not own or operate the mobile networks used to provide Data Plans and are not responsible for network outages, congestion, coverage gaps, regulatory restrictions, or other factors outside our reasonable control that affect the performance of a Data Plan.
15.3 You are responsible for ensuring that your use of a Data Plan, and any device on which it is installed, complies with the laws and regulations of the destination in which it is used, including any local requirements relating to telecommunications, SIM/eSIM registration, or data usage.
16. Limitation of Liability
16.1 To the fullest extent permitted by law, neither Flow nor its directors, employees, affiliates, or Network Partners will be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunity, arising from your use of the OkieSIM Platform or a Data Plan.
16.2 Our total aggregate liability to you in respect of any Order is limited to the amount you paid for that Order.
16.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
16.4 In particular, and without limiting section 16.3, nothing in these Terms excludes or restricts our liability for death or personal injury resulting from negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Where you deal as a consumer, any exclusion or restriction in these Terms applies only so far as it is reasonable under the Control of Exemption Clauses Ordinance (Cap. 71), and the term implied by the Supply of Services (Implied Terms) Ordinance (Cap. 457) that we will carry out our service with reasonable care and skill is not excluded.
16.5 Each exclusion and limitation in this section operates separately. If any is held to be unenforceable, the others continue to apply.
17. Indemnity
17.1 You agree to indemnify and hold Flow, its officers, employees, and affiliates harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the OkieSIM Platform or a Data Plan. This indemnity does not apply to the extent that the claim arises from our own breach, negligence, or wilful misconduct, and where you deal as a consumer it is limited to loss that is a reasonably foreseeable consequence of your breach.
18. Force Majeure
18.1 We are not liable for any failure or delay in performing our obligations under these Terms to the extent it is caused by an event beyond our reasonable control, including natural disaster, war, civil unrest, epidemic, industrial action, failure of a Network Partner network, power or internet failure, cyber attack, or the act, order, or restriction of a government or regulator.
18.2 Where such an event prevents a Data Plan from being used for a material part of its validity period, we will, at your option, extend the validity period or refund the unused portion.
19. Third-Party Links and Services
19.1 The OkieSIM Platform may contain links to third-party websites or services, including payment providers and Network Partners. We do not control and are not responsible for the content, policies, or practices of any third-party site or service.
20. Complaints and Dispute Resolution
20.1 If you are unhappy with any aspect of our service, please contact support@flowtheroom.com with your order reference and a description of the problem. We will acknowledge your complaint within two working days and aim to resolve it within fourteen days. Where we need longer, we will tell you why and give you an expected date.
20.2 If we cannot resolve your complaint, you may refer it to the Consumer Council in Hong Kong or, if you are a consumer resident elsewhere, to any consumer dispute resolution body available to you under local law. Nothing in this section affects your right to bring legal proceedings.
21. Notices
21.1 We will give notices to you by email at the address associated with your Order or account, or by posting them on the OkieSIM Platform. A notice sent by email is treated as received on the day it is sent, unless we receive a delivery failure message.
21.2 You may give notices to us at support@flowtheroom.com, or by post to the address in section 27.
21.3 You are responsible for keeping your email address current and for checking that our messages have not been filtered as spam.
22. Changes to These Terms
22.1 We may amend these Terms at any time by posting the updated Terms on the OkieSIM Platform, with the "Effective date" updated accordingly. Changes apply prospectively and do not affect Orders placed before the change took effect. Where a change materially affects your rights, we will give you reasonable notice by email or through a prominent notice on the OkieSIM Platform before it takes effect. Your continued use of the OkieSIM Platform after a change takes effect constitutes acceptance of the updated Terms. If you do not accept a change, you should stop using the OkieSIM Platform and may close your account under section 12.4.
23. Assignment
23.1 You may not assign or transfer your rights or obligations under these Terms, or any Data Plan, without our prior written consent.
23.2 We may assign or transfer our rights and obligations under these Terms to another member of our group, or to a purchaser of the OkieSIM business, provided that doing so does not reduce your rights under these Terms.
24. Relationship of the Parties and Third-Party Rights
24.1 Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Flow, or between Flow and any Network Partner.
24.2 Our directors, officers, employees, affiliates, and Network Partners may enforce the exclusions and limitations in sections 15, 16, and 17 as if they were a party to these Terms, under the Contracts (Rights of Third Parties) Ordinance (Cap. 623). No other person has any right to enforce any provision of these Terms under that Ordinance.
24.3 You and Flow may vary or rescind these Terms without the consent of any person who has a right to enforce them under section 24.2.
25. Governing Law and Jurisdiction
25.1 These Terms are governed by the laws of Hong Kong. You and Flow submit to the non-exclusive jurisdiction of the courts of Hong Kong in respect of any dispute arising out of or in connection with these Terms.
25.2 If you are a consumer, this section does not deprive you of the protection of the mandatory consumer law of your country of residence, and does not prevent you from bringing proceedings in the courts of that country where local law gives you that right.
26. General
26.1 These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flow regarding the OkieSIM Platform and supersede any prior agreements.
26.2 If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable or, where that is not possible, severed, and the remaining provisions will continue in full force and effect.
26.3 Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
26.4 These Terms are provided in English. Where translated into another language, the English version prevails in case of conflict.
26.5 Headings are for convenience only and do not affect interpretation.
26.6 Flow Travel Technology Limited is the service provider responsible for the OkieSIM Platform. OkieSIM does not act as a mobile network operator or licensed telecommunications carrier in any jurisdiction unless expressly stated.
